Practice Areas
We help Long Island families protect what they have worked for and get the care they need. Every plan starts with a conversation about your family, your home, and what worries you, and every fee is quoted before work begins.
Medicaid Asset Protection Trusts
A Medicaid asset protection trust lets you protect your home and savings from the cost of long-term care while you continue to live in your home and control your income. Once assets have been in the trust for five years, they are not counted when you apply for nursing home Medicaid, and they pass to your family without probate.
We draft the trust for your situation, prepare and record the deed, and guide you through moving the right assets into it and keeping the wrong ones out. You will understand what the trust does before you sign it.
Medicaid Applications
Applying for Medicaid to pay for home care or a nursing home is a document-heavy process, and a missing statement or an unexplained transfer can mean months of delay. We prepare and file the application, assemble the financial record the county requires, and answer the agency’s questions until a decision is made.
For home care, we also handle the pooled income trust that lets you keep your income above the Medicaid limit while still qualifying. For nursing home care, we work through the spousal protections and the five year look-back so that the application is approved the first time.
Gift and Loan Planning
When a parent needs nursing home care now and no trust was set up in advance, it is still possible to protect a meaningful part of the estate. A gift and loan plan uses the Medicaid rules themselves to preserve roughly half of what would otherwise be spent on care.
We calculate the plan, prepare the documents, and coordinate the timing with the Medicaid application. This is time-sensitive work, and the earlier we are involved, the more can be saved.
Estate Planning
A good estate plan is more than a will. We prepare wills, revocable and irrevocable trusts, powers of attorney, and health care proxies, and we explain how they work together so that someone you trust can act for you if you cannot, and so that your family is spared a court process when you are gone.
Every plan is built around your family and your wishes, not a form. We meet with you, draft the documents, review them with you, and supervise the signing so that everything is done correctly.
Probate and Estate Administration
When a loved one dies, someone has to take the estate through Surrogate’s Court, collect the assets, pay what is owed, and distribute what remains. We handle probate when there is a will and administration when there is not, and we keep the family informed at every step.
We do not handle contested estates or will challenges. If a dispute arises, we will refer you to an experienced litigator and stay involved as needed.
